Vitatoe Real Estate Group is affiliated with KW Professionals, a Keller Williams brokerage. Each office is independently owned and operated.
By accessing or using the Site, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the Site.
1. Use of the Site

3.1 IDX and MLS content
Our Site may display real estate listings and related data provided through Internet Data Exchange (IDX) or Multiple Listing Service (MLS) providers. This information is deemed reliable but is not guaranteed accurate and should be independently verified.
3.2 Accuracy and updates
Property information, including but not limited to price, square footage, availability, and features, may change at any time and may not be updated in real time. We do not guarantee that any listing will be available at the time you view it or at the time you make an inquiry.
3.3 Intellectual property of listings
Listing data, including photos, descriptions, and other content, may be the copyrighted property of the listing broker, MLS, or other content providers. You may not copy, reproduce, distribute, or create derivative works from this content without the appropriate owner’s prior written consent.
4. User accounts and lead forms
4.1 Account creation
If you create an account on the Site (including for saved searches, favorites, or alerts), you are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
4.2 Lead and contact forms
When you submit your information through forms on the Site (such as contact forms, request‑a‑showing forms, or IDX registration), you agree that the information you provide is accurate and complete and that you have the right to provide it. You also agree that we may contact you as described in our Privacy Policy and any consent language presented with the form.
4.3 Termination of access
We may suspend or terminate your access to the Site or your account at any time, with or without notice, if we believe you have violated these Terms or engaged in inappropriate or unlawful conduct.
5. Communications (calls, texts, emails)

We are not responsible for the content, policies, or practices of any third‑party sites or services and make no warranties regarding them.
Your use of third‑party sites and services is at your own risk and subject to their terms and policies.
8. Disclaimer of warranties
THE SITE AND ALL CONTENT AND SERVICES AVAILABLE THROUGH THE SITE ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT ANY WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED.
TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT. TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL VITATOE REAL ESTATE GROUP, KW PROFESSIONALS, THEIR OWNERS, AGENTS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS WILL NOT EXCEED ONE HUNDRED DOLLARS (USD $100) OR THE AMOUNT YOU HAVE PAID TO US FOR SERVICES ACCESSED THROUGH THE SITE IN THE PAST TWELVE MONTHS, WHICHEVER IS GREATER.

You agree to indemnify, defend, and hold harmless Vitatoe Real Estate Group, KW Professionals, and their owners, officers, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:

Your violation of any rights of another person or entity.

Your continued use of the Site after any changes to the Terms constitutes your acceptance of the revised Terms.

13. Governing law and jurisdiction

These Terms, together with our Privacy Policy and any additional terms or disclosures provided on the Site, constitute the entire agreement between you and us regarding your use of the Site and supersede any prior understandings or agreements (whether oral or written) relating to the same subject matter.
